Terms of Service

1. Introduction

These Terms of Service (“Terms”) govern your access to and use of the website namibia-realestate.com, associated applications, and all related products and services (collectively, the “Platform”) operated by Realestate-Namibia (“we”, “us”, “our”).

By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, you must immediately cease using the Platform.

2. Definitions

  • “User” means any person who accesses or uses the Platform, whether registered or unregistered.
  • “Registered User” means a User who has created an account on the Platform.
  • “Services” means all products, reports, data, tools, and features available on the Platform.
  • “Property Data” means property-related information sourced from the Namibian Deeds Office, municipal records, and other public or contributed sources.
  • “Content” means all text, images, data, reports, maps, graphics, and other materials available on the Platform.

3. Eligibility

You must be at least 18 years old and have the legal capacity to enter into binding agreements under the laws of the Republic of Namibia to use the Platform. By using the Platform, you represent and warrant that you meet these requirements.

4. Account Registration

Certain features require account registration. When registering, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information to keep it accurate
  • Keep your login credentials confidential and secure
  • Accept responsibility for all activity under your account
  • Notify us immediately of any unauthorised use of your account

We reserve the right to suspend or terminate accounts that violate these Terms or provide false information.

5. User Roles and Access

The Platform supports different user roles (e.g., Buyer, Seller, Estate Agent, Valuator, Financial Institution). Access to certain features and data may be restricted based on your assigned role, subscription tier, and verification status. Professional users may be required to provide proof of qualifications (e.g., NEAB registration).

6. Services and Property Data

6.1 Property Reports and Valuations

Property reports, automated valuations, market analytics, and related services are provided for informational purposes only. While we strive for accuracy, we do not guarantee the completeness, reliability, or suitability of any data or report for a particular purpose.

6.2 Data Sources

Property Data is sourced from the Namibian Deeds Office (public domain), municipal valuation rolls, user contributions, and other public sources. We do not warrant that this data is error-free or up to date. Users should independently verify information before making financial or legal decisions.

6.3 Contributed Data

Users may contribute property information, photographs, and documents through the Platform. By contributing, you warrant that you have the right to share such information and grant us a non-exclusive, royalty-free licence to use, display, and process the contributed data for the purposes of our Services.

7. Fees and Payment

Certain Services are available on a paid basis. Fees are displayed on the Platform and may change from time to time. By purchasing a Service, you agree to pay the applicable fees. All payments are non-refundable unless otherwise stated or required by law.

8. Intellectual Property

All Content, software, designs, logos, trademarks, and other intellectual property on the Platform are owned by or licensed to Realestate-Namibia. You may not copy, reproduce, distribute, modify, or create derivative works from any Content without our prior written consent.

Property Data derived from public sources remains in the public domain; however, our curation, analysis, presentation, and value-added processing of that data constitutes our proprietary intellectual property.

9. Acceptable Use

You agree not to:

  • Use the Platform for any unlawful purpose
  • Access, scrape, or harvest data using automated means (bots, crawlers, etc.) without prior authorisation
  • Attempt to gain unauthorised access to any part of the Platform or its systems
  • Interfere with or disrupt the Platform’s security or functionality
  • Impersonate any person or entity
  • Upload malicious code, viruses, or harmful content
  • Use Property Data for purposes that violate POPIA or other applicable laws
  • Resell, redistribute, or commercially exploit Platform data without authorisation
  • Use personal information obtained through the Platform for unsolicited marketing

10. Data Protection and Privacy Principles

Our processing of personal information is governed by our Privacy Policy and applicable laws of the Republic of Namibia. Although Namibia has not yet enacted comprehensive data protection legislation equivalent to POPIA, we voluntarily adopt and apply POPIA principles as our standard for responsible data handling.

If you are a professional user accessing personal information through the Platform (e.g., property ownership data), you are considered the Responsible Party under these principles and must ensure you have a valid legal basis for processing such information. Misuse of personal information obtained through the Platform may result in account termination and legal action.

11. Limitation of Liability

To the maximum extent permitted by law:

  • The Platform and Services are provided “as is” and “as available” without warranties of any kind, express or implied.
  • We do not warrant that the Platform will be uninterrupted, secure, or error-free.
  • We shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Platform.
  • Our total liability for any claim shall not exceed the amount you paid to us in the 12 months preceding the claim.
  • We are not liable for decisions made based on Property Data, reports, or valuations provided through the Platform.

12. Indemnification

You agree to indemnify and hold harmless Realestate-Namibia, its directors, employees, agents, and partners from and against any claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising from:

  • Your use or misuse of the Platform
  • Your violation of these Terms
  • Your violation of any applicable law or regulation
  • Your infringement of any third-party rights
  • Any data you contribute or submit through the Platform

13. Third-Party Links and Services

The Platform may contain links to third-party websites or services. We do not control, endorse, or assume responsibility for any third-party content. Your interaction with third-party services is governed by their respective terms and policies.

14. Advertising

The Platform may display advertisements from third parties. We are not responsible for the content of such advertisements or the products and services they promote. Advertising enquiries may be directed to realestate.namibia@gmail.com.

15. Suspension and Termination

We reserve the right to suspend or terminate your access to the Platform at any time, without notice, for any reason, including but not limited to violation of these Terms. Upon termination, your right to use the Platform ceases immediately. Provisions that by their nature should survive termination shall remain in effect.

16. Modifications

We may modify these Terms at any time. Changes take effect upon posting on the Platform. Continued use of the Platform after changes are posted constitutes your acceptance of the modified Terms. We encourage you to review these Terms periodically.

17. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Republic of Namibia. Any disputes arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of the Republic of Namibia.

18. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Realestate-Namibia regarding the use of the Platform.
